1. Agreement to Terms

By accessing or using PhotoLabs ("Service"), operated by TechRadar LTD (Company Number: 16446173), a company registered in England and Wales, you agree to be bound by these Terms of Service.

2. Description of Service

PhotoLabs provides batch image processing services for online resellers, including background removal, marketplace-specific image formatting, and ZIP export. The Service operates on a tier-based subscription system.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Billing

• The Service offers a Free tier (50 images per month) and a Pro tier (10,000 images per month at £10/month or £89/year)
• Usage limits reset monthly and do not roll over to the next billing period
• Prices are shown in GBP and converted at checkout by Stripe
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel at any time via the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period
• Refunds are provided at our discretion on a case-by-case basis

5. Acceptable Use

You agree not to:

• Upload illegal, harmful, or offensive content
• Violate any intellectual property rights
• Attempt to reverse engineer or compromise the Service
• Use the Service for any automated or bulk processing beyond your plan limits
• Resell or redistribute processed images as a service to third parties

6. Intellectual Property and Image Handling

You retain all rights to images you upload. By using the Service, you grant us a limited license to process your images solely for the purpose of providing the Service. We do not claim ownership of your content. Images are sent to a third-party AI provider (Replicate) for background removal and are automatically deleted within 1 hour of processing. We do not store your original or processed images beyond the time needed to deliver your results.

7. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice.

8. Limitation of Liability

To the maximum extent permitted by law, TechRadar LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

9. Termination

You may cancel your subscription at any time via the billing dashboard. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your access to the Service will cease. We do not retain your images after processing.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
